Wheatfields Estate is a homeowners’ association and not a sectional title scheme. A homeowners’ association is governed by its duly registered Constitution and has a board of trustees who is tasked with raising levies, appointing suppliers to the Estate, managing the common areas and shared services and enforcing the Estate rules, amongst others. Unlike in a sectional title scheme (which has a body corporate and which is governed solely by the Sectional Titles Schemes Management Act 8 of 2011) where the body corporate looks after each property, in a homeowners’ association each owner of a freestanding property in the Estate (such owner being a member of the homeowner’s association) is responsible for his/her own property and for compliance with the Estate’s Constitution and Code of Conduct.
